Section 68
Appointment of labor assistants
: (1) The Government of Nepal shall appoint at least one gazetted officer as labor assistant in the country where five thousand or more workers have been sent for foreign employment.
(2) The work, duties and rights of the labor assistant will be as follows:
(a) To inform the Government of Nepal about the labor and employment status of the countries where Nepali workers are located, factual information related to immigration and the steps taken by that country to protect labor and international human rights and workers' interests,
(b) If any dispute arises between workers, employers or licensees, to assist in solving the problem,
(c) Making necessary arrangements to bring back the workers stranded during foreign employment,
(d) If there are jobs available according to the skills of Nepali workers in the respective countries, to provide the relevant information to the Government of Nepal (e) Taking initiatives to repatriate dead bodies of workers affected by natural calamities or who died due to any reason with the help of the concerned country or employer organization,
(f) To try to make a bilateral agreement at the government level for supply of workers from Nepal,
(g) providing necessary counseling to the worker and discouraging him from doing other than the work mentioned in the contract,
(h) Supervising activities that may affect workers, and
(i) To perform other tasks prescribed by the Government of Nepal from time to time.
(3) If there are both diplomatic missions and labor assistants in a foreign country, the obligation to perform the work and duties mentioned in sub-rule (1) shall be vested in the labor assistant.
